What is TCPA compliance?
The Telephone Consumer Protection Act (TCPA) regulates, among other things, calls to cell phones without the express consent of the called party when an automatic telephone dialing system (ATDS) is used to place the call. The TCPA defines an ATDS as “equipment which has the capacity to store or produce telephone numbers to be called, using a random or sequential number generator; and to dial such numbers.”. Under the TCPA, the Federal Communications Commission (FCC) was given the power to issue rules and regulations when implementing the TCPA.
For SaaS and technology-based companies — and really any business that relies on outbound sales communication, it is imperative that they are TCPA compliant when making phone calls to mobile phones because TCPA can be a source of unwanted regulatory violations and unnecessary fines.

The FCC has previously stated that human intervention is required to make each call and the required level of human intervention will be based on how the equipment functions and on a case-by-case determination. We engaged an outside expert to perform an independent, third-party operational review of Koncert dialers to assess whether they constituted an Automatic Telephone Dialing System (ATDS) under the TCPA. Based on the comprehensive review of our system, the third-party concluded that Koncert dialers do not meet the statutory or expanded definitions (as defined by judicial interpretation) of an ATDS.

Why TCPA Compliance Matters
The TCPA provides for statutory damages of $500 per instance of a TCPA violation which can be increased to $1500 per instance if the violation is determined to be knowing or willful. Each dial made could effectively be a violation under the TCPA’s vague definition of ATDS.
In 2018, the U.S. Chamber Institute for Legal Reform, in it’s article “TCPA Lawsuits are HOW Expensive?” cited $6.6 million as the average cost of a TCPA settlement based on TCPA litigation data compiled by WebRecon.
In a recent Jan 2021 class action lawsuit settlement, Saliba v. KS StateBank Corp., (pending in the U.S. District Court, District of Arizona), a $775,000.00 settlement was reachedregarding claims alleging that KS StateBank Corporation caused automated marketing text messages to be sent to wireless telephone numbers without the express written consent of the recipients in violation of the Telephone Consumer Protection Act. This settlement represents a settlement of $198 per text sent.
